Question 1: Describe some characteristics of pirated software.

Answer 1: There are numerous indicators of pirated software. For instance, software that comes in unofficial packaging is likely to be pirated. If the documentation and labeling for the software are handwritten, it is likely that the software is not official. Some software is meant specifically for new computers, and is designated by labels reading “academic” or “OEM” (original equipment manufacturer). This software is not to be copied or sold. Software that comes in a transparent case with no labeling has probably been pirated. The presence of programs from several different publishers in one package also indicates possible pirating. Finally, either a photocopied manual or the absence of a manual altogether indicates that the software has been copied illegally.

Question 2: Describe the end-user license agreement (EULA).

Answer 2: A EULA, or end-user license agreement, appears when newly-installed software is run for the first time. It requires the user to confirm agreement with the license terms by pressing a button. Unless the user agrees with the license terms, the program will not run. By pressing the button that indicates agreement, the user enters into a legal contract with the software publisher. Any failure to observe the terms of the agreement can make the user liable. Typically, the EULA includes the limitations of the license and the terms of the warranty.

Question 3: Describe shrink-wrap licenses.

Answer 3: A shrink-wrap license is established as soon as the customer removes the software from its packaging. It is a non-verbal agreement which the customer may be unaware of having entered. However, the shrink-wrap license has some legal validity so long as it is indicated by text on the outside of the software package. If there is a clear description of the shrink-wrap license, it does not need to be read by the customer to be valid and enforceable.
